In the case of Cranwell v. Cranwell, the Virginia Court of Appeals, in an unpublished opinion, held that a longstanding romantic relationship between a wife and her boyfriend who lives on the West Coast was not cohabitation. Wife is a flight attendant and only visits the boyfriend occasionally. She does not have a key to his apartment and vice versa. While they each store a few personal items at the other's residence, the combination of the foregoing do not amount to cohabitation. A good Charlottesville Divorce Lawyer or Charlottesville Spousal Support Lawyer will know that cohabitation in violation of an agreement prohibiting such cohabitation or even in the absence of an agreement where it lasts for a year will justify the termination of an award of spousal support unless it would be unconscionable to do so.
